1. ACCEPTANCE OF TERMS

By accessing or using this website (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Use (the “Terms”), including our Privacy Policy, and all applicable laws and regulations. You are responsible for ensuring your use of this Site complies with all applicable federal, provincial, and local laws in your jurisdiction.

If you do not agree to these Terms, you must immediately cease all use of and access to this Site.

All content, materials, information, text, graphics, logos, images, and other intellectual property displayed on this Site are protected by Canadian and international copyright, trademark, and other intellectual property laws, and are the property of Express Repair or its licensors.

2. LIMITED LICENSE TO USE SITE MATERIALS

Express Repair grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and to download one copy of the materials (including information and software) available on the Site solely for your personal, non-commercial use. This is a license only and not a transfer of title or ownership.

Restrictions on Use

Under this license, you may not:

1. Modify, copy, reproduce, republish, or distribute any materials from the Site;
2. Use the materials for any commercial purpose or for any public display, whether commercial or non-commercial;
3. Attempt to decompile, reverse engineer, disassemble, or hack any software, code, or technology contained on or accessible through the Site;
4. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the materials;
5. Transfer, sell, license, or assign the materials to any third party; or
6. Mirror, frame, or replicate the materials on any other server or website.

Termination of License

This license will automatically terminate immediately if you violate any of these restrictions. Express Repair may also terminate or suspend this license at any time, with or without notice, for any reason. Upon termination of this license, you must immediately destroy all downloaded or printed materials in your possession or control.

3. SERVICE TERMS AND CONDITIONS

By requesting service from Express Repair, you authorize the service to be performed and accept all terms and conditions set forth in this Section 3.

3.1 Service Call Fees

• Service call fees typically starts from $99 plus applicable HST, depending on location, time of day, and other factors
• The service call diagnostic fee starts at $99 plus taxes per appliance
• Service call fees are non-refundable under all circumstances
• Labour fees are non-refundable
• Deposits (if applicable) are non-refundable
• A second technician fee starts from $99 plus tax applies when required

3.2 Appointment Cancellation Policy

• To cancel an appointment without charge, you must contact our office and speak with a live agent at least 3 hours before the scheduled appointment time
• Failure to provide proper notice will result in a cancellation fee of $99 plus tax

3.3 Parts and Warranty Policy

Parts Ordering and Returns:

• Electronic parts ordered or installed by Express Repair cannot be returned or refunded
• By canceling an order or installation, you acknowledge that you will be required to pay the full amount for parts that were ordered or installed
• In some cases, with manager approval only, a 30% restocking fee may be charged for returned parts

Warranty Coverage:

• Express Repair guarantees only the parts that were repaired or replaced by Express Repair for the number of days stated on your invoice
• No other parts of the appliance are included in the warranty
• If repair was completed without replacing a part, the amount paid cannot be refunded
• Warranty is not transferable to any other person or party

Exclusions from Warranty:

• Consequential damages are not covered
• Incidental expenses are not covered
• Water damage is not covered or refundable
• Food spoilage is not covered or refundable

3.4 Property Protection and Liability

Express Repair technicians make every effort to leave the work area as clean as it was prior to service. However, some repair jobs require moving appliances. By ordering service, you acknowledge and agree that Express Repair and its technicians will not be held liable for any damage to floors, walls, or other property that may occur during the course of service.

3.5 Payment Terms

Payment Due: Payment terms are due upon receipt of invoice.

Late Payment: Invoices that are 30 days overdue or payments that are cancelled will be charged a late fee of $99. Unpaid invoices may be sent to a third-party collection agency.

Payment Methods:

• E-Transfer (Canada only): Must be sent to [email protected]
• Credit Card: A convenience starts from 2.4% will be added to the total bill when paying by credit card

Taxes: All prices are subject to applicable taxes (HST).

3.6 Coupons and Discounts

All online or offline coupons and discounts apply exclusively to repair costs and do not cover the service call fee.

4. DISCLAIMER OF WARRANTIES

The materials on Express Repair’s website are provided on an “as is” and “as available” basis. Express Repair makes no warranties, expressed or implied, and hereby disclaims and negates all warranties, including without limitation:

1. Implied warranties or conditions of merchantability;
2. Fitness for a particular purpose;
3. Non-infringement of intellectual property or other violation of rights;
4. Accuracy, reliability, or completeness of materials;
5. That the Site will be uninterrupted, secure, or error-free; or
6. That any defects will be corrected.

Express Repair does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this Site.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Express Repair or its suppliers, officers, directors, employees, or agents be liable for any damages (including, without limitation, damages for loss of data, loss of profit, business interruption, or any other pecuniary loss) arising out of:

1. The use or inability to use the materials on Express Repair’s website;
2. Any services provided by Express Repair;
3. Unauthorized access to or alteration of your transmissions or data;
4. Statements or conduct of any third party on the Site; or
5. Any other matter relating to the Site or services.

This limitation applies even if Express Repair or an Express Repair authorized representative has been notified orally or in writing of the possibility of such damage.

Jurisdictional Limitations: Some jurisdictions do not allow the exclusion of implied warranties or limitations of liability for consequential or incidental damages. In such jurisdictions, Express Repair’s liability shall be limited to the maximum extent permitted by law.

6. ACCURACY OF MATERIALS

The materials appearing on Express Repair’s website may include technical, typographical, or photographic errors. Express Repair does not warrant that any of the materials on its website are accurate, complete, or current.

Express Repair may make changes to the materials contained on its website at any time without notice. However, Express Repair does not make any commitment to update the materials.

7. THIRD-PARTY LINKS

Express Repair has not reviewed all of the websites linked to its Site and is not responsible for the contents of any such linked website. The inclusion of any link does not imply endorsement by Express Repair of the linked website.

Use of any linked website is at the user’s own risk. Express Repair disclaims all liability for any damages arising from your use of third-party websites.

8. MODIFICATIONS TO TERMS

Express Repair reserves the right to revise these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes.

It is your responsibility to review these Terms periodically for updates. The “Last Updated” date at the top of this document indicates when these Terms were last revised.

9. GOVERNING LAW AND JURISDICTION

These Terms and any claim, dispute, or controversy arising out of or relating to these Terms, the Site, or services provided by Express Repair shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any disputes arising from these Terms or your use of the Site or services.

10. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

11. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Express Repair regarding your use of the Site and services, and supersede all prior agreements and understandings, whether written or oral.
